REFUND & CANCELLATION POLICY

1. INTRODUCTION

Zoan, a Partnership Firm, operates as a marketplace facilitator connecting buyers with independent breeders. We understand that purchasing a pet is a significant decision, and we are committed to fair and transparent refund practices while protecting the interests of all parties.

This policy defines when refunds and cancellations are applicable, in compliance with the Consumer Protection Act, 2019, Sale of Goods Act, 1930, and Indian Contract Act, 1872.

2. IMPORTANT NOTICE – NATURE OF PRODUCTS

Live animals are not ordinary consumer goods. They are living beings with unique characteristics, personalities, and natural variations. Due to the special nature of these products:

  • Returns and exchanges are highly restricted
  • Pre-delivery inspections and veterinary checks are mandatory
  • Buyer due diligence is essential before purchase
  • Certain refund eligibility criteria apply

Your statutory consumer rights under Indian law are fully protected and cannot be waived.

3. PAYMENT STRUCTURE

3.1 Full Payment at Booking

  • The buyer pays the entire amount (pet cost + shipping + taxes) at the time of order confirmation.
  • Payment confirms your order and reserves the pet.
  • Zoan holds the payment in trust until delivery and acceptance.

3.2 Payment Disbursement

Payment is released to the breeder only after successful delivery, buyer acceptance, and expiry of the 7-day health guarantee period (if no issues are reported).

4. CANCELLATION POLICY

4.1 Cancellation by Buyer (Before Dispatch)

You have the right to cancel your order before the pet is dispatched.

Refunds are processed within 7–10 business days.

4.2 Cancellation by Breeder (Before Delivery)

A full refund will be issued if the breeder cancels or cannot deliver the pet for health or compliance reasons. Refund includes 100% pet cost, 100% shipping charges, and any additional payments.

Compensation up to ₹2,000 is provided for documented travel expenses.

4.3 Cancellation Due to Delivery Location

If you cannot reach the designated pickup point, you may cancel before dispatch and receive a 100% refund, provided the pickup point was not clearly communicated before payment.

5. REFUND POLICY – POST-DELIVERY

5.1 Consumer Rights

You are entitled to refunds under the Consumer Protection Act, 2019 and Sale of Goods Act, 1930 in specific situations.

5.2 Refund Eligibility – Mandatory Grounds

A. Health-Related Issues (2-Day Guarantee)

Full refund is provided if the pet is diagnosed within 2 days with:

  • Undisclosed contagious disease
  • Serious genetic/hereditary defects
  • Pre-existing medical conditions
  • Death caused by pre-existing condition

Documentation required includes veterinary certificates and diagnostic reports.

Not covered: negligence, stress issues, minor ailments, injuries after delivery, or issues arising from improper care.

B. Misrepresentation or Fraud

Full refund if:

  • Wrong breed delivered
  • Wrong gender
  • Incorrect age (difference of more than 2 months)
  • Fake documentation
  • Wrong pet delivered

Refund includes shipping and veterinary examination costs (up to ₹3,000).

5.3 Refund Not Available – Exclusions

Refund will not be provided for:

  • Change of mind
  • Appearance or size dissatisfaction
  • Behavioural issues
  • Lifestyle problems
  • Health issues arising after 7 days
  • Buyer negligence
  • Natural variations in pet development

5.4 Replacement Option

You may choose a full refund or a replacement pet (same breed, age, gender) at no extra cost. Replacement is optional.

6. REFUND CLAIM PROCESS

6.1 Steps

  1. Notify Zoan immediately (email/phone/WhatsApp).
  2. Provide order details and evidence.
  3. Take the pet to a licensed vet.
  4. Submit veterinary documentation.
  5. Investigation completed within 7–10 business days.
  6. Refund issued once pet is returned (if applicable).

6.2 Evidence Requirements

Includes clear photos, vet certificates, test results, screenshots, DNA reports (if required), and order documentation.

7. DUPLICATE PAYMENT REFUND

Duplicate payments are refunded within 3–5 business days after verification.

8. REFUND METHOD & TIMELINE

8.1 Method

Refunds are issued to the original payment method or via bank transfer.

8.2 Timeline

  • Duplicate payment: 3–5 days
  • Breeder cancellation: 5–7 days
  • Buyer cancellation: 7–10 days
  • Approved claims: 7–10 days after pet return

9. MARKETPLACE DISCLAIMER & LIABILITY

Zoan is a facilitator, not the seller. The breeder is responsible for pet accuracy, health, legality, and documentation. Zoan is accountable for platform malfunctions, failure of verification, and negligence in dispute handling.

Zoan is not liable for breeder fraud undetectable through due diligence, buyer negligence, pre-existing conditions undetectable before sale, or force majeure.

10.2 Legal Rights

11. SPECIAL CIRCUMSTANCES

11.1 Force Majeure

Delays exceeding 30 days: full refund.

11.2 Pet Death During Transit

Full refund + insurance claim processing.

11.3 Breeder Out of Business

Zoan will complete delivery or issue full refund.
